Legal framework
- No law currently that prohibits surrogacy
- In Kenya, it’s legal for a foreign national to undergo Embryo Transfer under a private arrangement that the surrogate may have with any Intended Parent. And our agency will facilitate this process whilst giving you access to the best legal and medical advice.
Eligibility
- Single parent (male, female)
- Same-sex married Intended parents
- Married heterosexual intended parents
Birth certificate:
- Issued in 10-15 days,
- In the case of married IPs, their names are indicated
- In the case of same-sex/single parents surrogate name appears on the BC with a notarized waiver of parental rights affidavit
- For EU nations: a court order for Sole custody of parental rights.
Exit procedure timelines
- Americans – 3 weeks at the most
- Australians – 4- 5 weeks.
- UK – 4 weeks
- Canadians – 2 weeks
- Chinese – 2 weeks
Egg donation (Anonymous/Non-Anonymous)
- Both forms are allowed
Surrogate matching period
- Around 1 week at the most
Insurance
- No private health insurance for surrogates after they are pregnant. However, the cost of the treatment/admissions in case of emergencies is not that high.

- How long does it take on average from the beginning to prepare the initial paperwork to insert the embryo into the surrogate?
