Surrogacy Laws in Colombia

Is surrogacy legal in Colombia?

surrogacy in colombiaAny laws do not specifically govern surrogacy. The fertility sector is growing in popularity since it offers affordable surrogacy in Columbia starting at $60,000 and guarantees success rates. This all-inclusive package covers every aspect of surrogacy, from a free consultation to a program for healthy live deliveries and no restrictions in Colombia. “Children born in or out of wedlock, adopted and procreated naturally or with scientific assistance, have equal rights and duties,” the Colombian constitution declares.

In 2009, Colombia provided more clarification about surrogacy, stating that although assisted reproductive technology and surrogacy are not specifically prohibited, surrogate motherhood is legally recognized regardless of the surrogate’s country of origin.

To legally replace the surrogate mother’s name on a child’s birth certificate with their own, intended parents may file an appeal with a Columbian court. Any child born via surrogacy automatically becomes a citizen of Colombia and is qualified to apply for a passport. On the other hand, it permits would-be parents to bring their child back home and obtain citizenship in their native city or familiar area. In 2016, Columbia made surrogacy accessible to same-sex couples based on constitutional interpretations given by the Columbian court.

Surrogacy process- How does surrogacy work legally in Colombia?

The Colombian Constitution does not specifically address surrogacy, but it does permit all methods of reproduction, including scientific ones, which legalizes the practice. There is legal precedent supporting surrogate contracts and the surrogacy act through a Constitutional Court decision.

A system for identifying a surrogate baby’s genetic parents is also included in the Civil Code. Discrimination against single intended parents, same-sex couples, or foreigners who are granted equal rights is prohibited by the Constitution.

Surrogate mother in Colombia: what intended parents should know

Gay Surrogacy in colombiaIn Colombia, surrogate mothers must have at least one child of their own and will need to undergo medical, psychiatric, and background checks before, during, and following the pregnancy. The future security and prosperity of the surrogacy program are ensured by such a careful and thorough selection process.

Since gestational surrogacy is allowed in Colombia, it implies that the surrogate mother will not be genetically related to the child. On the contrary, there is a direct biological connection between the child and his/her intended parents. This special advantage connects intended parents and their children on a genetic level and creates an immense feeling of fulfillment.

Cost of surrogacy in Colombia

A fully inclusive program for surrogacy in Colombia costs approximately $60,000; a guarantee program is also offered. That is the same cost as less than half of the United States and the comparable program in Eastern Europe. Because of the low cost of living and a lot of high-class infrastructure and medical facilities, Colombia offers surrogacy for an affordable price. The cost of living in Colombia is roughly one-third that in California.

To maintain the same standard of living that you may have with $1,500 in Bogota, you would need approximately $5,000 in Los Angeles. Lower living expenses result in lower surrogate compensation as well as medical costs.
