Legal framework
- The Supreme Court of Mexico (Suprema Corte de Justicia de la Nación) ruled that Tabasco’s restriction of surrogacy to Mexican citizens or married couples was unconstitutional. The court declared that all individuals, regardless of nationality, sexual orientation, marital status, or infertility status, have the right to access assisted reproductive technologies, including surrogacy.
- The ruling further affirmed:

- Children born via surrogacy have the same rights as those born through natural pregnancy.
- Parental recognition should be based on the intended parents’ procreational will, not genetics.
- While the implementation of surrogacy laws is left to individual states, the court provided guidelines for individuals, clinics, and agencies to follow, referencing the Political Constitution of Mexico (Title 1, Chapter 1, Article 4), which governs family and health rights.
- Gestational Surrogacy:Only surrogacy with no genetic link to the surrogate is recognized.
- Surrogacy must be altruistic, with the surrogate receiving no payment beyond reasonable expenses.

Birth certificate
- To obtain a birth certificate listing only the intended parent(s), a court action known as an Amparo Trial is required. Upon a favorable ruling, the court orders the Civil Registry to issue a birth certificate listing only the intended parent(s).
- The Amparo process typically takes 1 to 6 months, depending on the court and judge.
- Intended parents and the child must remain in Mexico during this period.

- All medical bills in case of premature delivery for up to 1 month are covered by the
- agency-all costs associated with Delivery are covered by up to 80 000 000 Mexican Pesos, for the emergency hospitalization cost may be up to 5000 USD
